Campaign: #BTSAs2026 | Effective Date: 17 September 2025
1. Definitions
Unless the context indicates otherwise, the following words and expressions have the meanings set out below (cognate expressions have corresponding meanings):
- Campaign: the #BTSAs2026 organised by Behind The Scenes Awards NPO.
- Campaign Period: 17 September 2025 (00:00) to 25 July 2026 (00:00).
- Nominee Announcement: Wednesday, 23 April 2026.
- Participant: any person who participates in the Campaign by voting.
- Promoter: Behind The Scenes Awards ("Behind The Scenes").
2. Application of Terms
By entering the Campaign the Participant agrees to be bound by these Terms, which the Participant confirms have been read and understood.
3. Entry Requirements
- Eligible Participants must be prepaid subscribers on Cell C, MTN, Telkom or Vodacom.
- To vote, send the Nominee Code to the designated shortcode and follow the prompts.
- Each SMS vote costs ZAR 2.00 (standard network charges may apply).
- Unlimited votes are permitted subject to the Participant’s own cost limitations.
- Participants must supply accurate and complete information when requested.
4. Award Terms
Participants stand a chance to win incentives communicated by the Promoter. Prize types, quantities, eligibility validation and distribution processes may be published separately. All prizes are subject to availability and successful verification.
6. Warranties and Indemnities
- The Promoter and its employees, officers, directors, agents and associates (the “Indemnified Parties”) are not liable for any claim, cost, loss, damage or penalty arising from participation in the Campaign. Participants indemnify and hold the Indemnified Parties harmless accordingly.
- Prizes (including any products or services) carry only the manufacturer or supplier warranties and usage instructions that accompany them.
7. Force Majeure
- If performance is prevented or delayed by events beyond reasonable control (including act of God, strike, war, riot, civil commotion, lockout, labour dispute, fire or similar) ("Force Majeure"), the Promoter will notify WASPA and seek appropriate relief.
- During Force Majeure the Promoter is not liable for delay, non‑performance or consequential loss attributable to the event.
8. General
- Amendments to these Terms require prior WASPA approval.
- Directors, members, partners, owners, employees, agents, consultants or any person affiliated with the Promoter may not participate.
- In case of dispute the Promoter’s decision is final and binding; no correspondence will be entered into.
- The service will not be cancelled, suspended or terminated without explicit WASPA consent.

9. Participant Conduct & Eligibility
- Participants must act honestly and uphold fair play throughout the Campaign.
- The Promoter may disqualify any Participant suspected of fraud, manipulation, automated voting or conduct undermining integrity.
- Employees and immediate family or business associates of the Promoter are ineligible.
10. Entry Fees & Charges
- Participants are responsible for all SMS and data charges incurred.
- Each SMS vote costs ZAR 2.00.
11. Publicity & Promotion
- Participants and winners consent to the use of their name and likeness for Campaign publicity without additional compensation (subject to lawful objections).
- The Promoter may feature winners in media including social platforms, press releases and advertisements.
12. Disputes
- Disputes are governed by South African law and handled in accordance with these Terms.
- Participants agree to abide by the Promoter’s determinations in relation to dispute resolution.
13. Limitation of Liability
- The Promoter, its agents, affiliates and sponsors are not liable for loss, damage, injury or inconvenience suffered during or arising from participation, except where liability cannot be excluded by law.
- The Promoter is not responsible for technical malfunctions, network interruptions or errors affecting entry, voting or prize fulfilment.
14. Governing Law & Jurisdiction
- These Terms are governed by the laws of the Republic of South Africa.
- Any dispute is subject to the exclusive jurisdiction of South African courts.
15. Severability
If any provision is held invalid or unenforceable, the remaining provisions continue in full force.
16. Language
These Terms are provided in English. If a translated version conflicts with this version, the English version prevails.
